    Ugh, I think the government should countersue for idiocy if they go through with the lawsuit. Honestly, if you're that lost in texting that you miss an open man hole cover you should probably just be locked away somewhere.

          Side 1: We have a local government office acknowledging that they made a mistake by opening the manhole first, instead of putting cones/barriers/warnings around it

          Side 2: We have a passerby who did not see the open manhole.

          Now, the passenger was a teen who was texting as she walked, and though it sounds funny (and it is), it is actually a very concern since it could have been an invalid (blind) who was walking into an open manhole.

              I am sure the solicitors with put up a good case for contributory negligence on the teenagers part which is likely to reduce the claim but the bottom line is that the manhole was left unprotected and the city has liability. I remember hearing of a case where thieves stole a manhole during the night and someone got injured but the city were still held responsible as ignorance of the situation is little defense in a court of law.

              It looks like she is still texting in the photograph...teenagers

                Is the city at fault? yes.
                Is the girl at fault? yes.

                They are both to blame.

                City should pay for whatever medical bills and time lost from work or what not and leave it at that.

                        Unfortunately in this day and age the family will win a huge settlement. Since we live in a spineless society that never takes ownership of it's screw ups they will definitely win any law suit.

                          So if someones texting and cross the street without looking and get ran over by a car its the car's fault?
