Weird the headline is wrong. In the article it says

Then the intruder who initially had the shotgun charged Keith Hoehn.

Kellie Hoehn told The Dallas Morning News that she screamed at her husband, "Shoot him, shoot him, shoot him."

In this case it is self defense. In CA they don't charge people for self defense...they charge folks who shot at people who are trespassing. A slight difference.

Actually, I know this one quite well through an unfortunate experience, and Mapes has a bad translation in regards to California Law.

In the event of Trespassing, you have no right to defend your property.
Trespassing is the first stage in a burglary, and is the case when you leave your doors and windows unlocked and there is no forcible entry.

Because Trespassing can include just plain being lost, it has been kept from the record to prevent people in the less populace places of our state from shooting accidental trespassers on-sight (think of all the farm land we have in California, plus all the acres of forested land that are private property).

Stage Two is breaking and entering. If you are at home, and they use force to enter your home, or a weapon is visible at the time of entry, you have the right to fire first and ask questions later. Therefore, it is better to keep your home locked in California.

In regards to the Texas story, I'm surprised that the people in the home werent armed.

In regards to the unfortunate story I reference:

In Highschool, two of my friends were at home on a school-night doing work on a physics project. The friend who lived there, their home was 3 stories and on several acres in a wealthy small hamlet- picture a small hilly version of Belair where Royalty and Presidents from around the globe own property in addition to some of the oldest money in all San Francisco Bay Area.

Some thief got a ladder from the handy-man lodge, carried out back, and extended it to climb in a window on the other side of the house. The two teenagers, hearing a sound, went to investigate, and saw this man climbing the ladder.

One went to grab the cordless phone, the other went to his room and got a pellet gun, which incidently was the strongest CO2 powered pellet hand-gun on the market at the time, and featured a dual CO2 cartridge injection.

As the window opened, the friend with the gun started screaming to the other on the phone "hear he comes, here he comes" and also said "DOnt come in I have a gun, I will use it"

The guy coming in the window looked up, made eye contact with him and smiled, saying " Listen you litte ******* I have one two, and when I get done climbing through this window, I'm going to kill you and your little buddy and rape your dead corpses."

I forgot to mention that the boy who lived there, his parents were in Europe and he was home alone with the other friend, who lived a few miles down in the same city.

The armed friend said he gave three warning.
The man put one leg over the windowsill
And my friend emptied the gun into his chest with such force that he fell the entire 3 stories (imagine 12 ft ceilings) and broke his arm, leg, shoulder and both wrists.

My friend got 5 years probation for assault with a deadly weapon and the man successfully sued the family for a high 6 figure sum.

The reason? The gun never came out, the window was unlocked, and when the police searched him, he had no weapon on him. And even though this was a serial break in criminal that they had been chasing for several years, responsible for thousands of dollars in theft and two very violent assaults during his crime spree, the state went hard on my friend for using a weapon.

The court maintained that in a home that big, the boys could have left the premises undetected and safely, without causing enormous bodily harm.

Oh yeah, and I think (cannot remember) they extracted more than 20 pellets from the man in surgery and had to leave several behind in him.

THAT is what the Trespassing law does in California.

Judges have to use, hey whats their title, oh yeah, judgement.
This whole BS in some states, my home state NC included, that they must forcefully enter you home, show a weapon and you must be fearful of your life is a load of crap.
I don't care where the hell I am, an individual entering my home does so at their own risk. I will not shoot to wound! When I shoot, it will be guaranteed they won't survive and before anybody ask, no I will not lose any sleep or have any feelings of guilt.

I live sorta close to the incident (maybe half hour driving), and it was a big story on the news for a few nights.

If anyone is interesting on the fully story, I can summarize it up in more detail than the link provided.

Apparently, the two men had the woman "corned" in a room, and they threatened to "blow her brains out" if she made any noise. She screamed, her husband came running in, and tackled the guy guarding the door, who had the pistol (remember there are 2 guys). He somehow pulled the shotgun away from his wife before the guy could fire, and then he ended up with the shotgun and successfully scared off the attackers. They interviewed them on the news, and they looked like any ordinary family: no "bodybuilders" or anything of that sort.

I guess it just goes to show what adrenaline can do to someone, and that criminals don't always follow through on their threats, especially if they are threatened themselves.
